This paper is intended to provide franchisors and lawyers experienced in franchising with a broad overview of legal considerations relating to Canadian franchising and expansion of franchise systems within or to Canada.  Topics covered include:

  • federal laws, including those related to trade-marks, copyrights, the patent act, privacy and immigration;
  • provincial franchise laws; and
  • information about expanding to Canada, including structuring the Canadian system and "Canadianizing" the franchise agreement.
