The Occupational Healthy & Safety (OHS) Group at Davis LLP embodies a philosophy of being proactive by helping clients across all industries improve workplace health and safety performance to protect their employees from harm and their business from liability and the rising cost of fines.

We consult with safety professionals, compliance officers, emergency preparedness staff, health & safety committee members, human resources and senior management to develop accident prevention programs and practical strategies to mitigate risk. We help ensure regulatory compliance with current rules and legislation, including Canada’s Occupational Health & Safety Act and related OHS regulations, as well as respective provincial Workers’ Compensations Boards. Our proactive approach includes customized in-house seminars and workshops to provide current industry information and a forum to discuss issues and answer questions in the privacy of their own premises.

When a serious workplace event does occur, we act as a first point-of-contact—24/7. We attend our clients’ site and immediately begin to guide them through the essential preliminary steps to manage appropriate compensation and avoid taxing litigation and prosecution.

Recent Representative Experience

  • Assistance with development, implementation and internal enforcement of Health and Safety Policies.
  • Investigation and co-ordination of response to Workplace Health and Safety relating to worker injury such as burns and finger amputations as a result of daily operations.
  • Investigation and co-ordination of response to Workplace Health and Safety relating to worker spinal fracture injury.
  • Investigation and co-ordination of response to Workplace Health and Safety relating to crush injury resulting in below knee amputation.
  • Review of obligations of prime contractor and question of ability to delegate prime status in context of large interprovincial contract.
  • Multiple fatality/serious injury investigations and response to regulator, appeal/ hearing before Occupational Health and Safety Council with respect to fatality, transition of prime contractor status from NGO to third party, and counsel on development of safe work systems for employers.
  • Involved with federal jurisdiction contesting instructions of safety officers before the Occupational Health and Safety Tribunal of Canada and the Appeal Officers appointed by the federal Minister of Labour.
