Biography
Lana Finney is a regulatory lawyer in the Toronto office of Davis LLP, whose practice has an emphasis on environmental and commercial litigation. Ms. Finney joined Davis in 2004, after having practiced in the Toronto office of another national firm.
Ms. Finney advises private and public sector clients on a broad range of environmental matters. She regularly advocates on behalf of clients at mediation sessions and appears before all levels of court in Ontario, regulatory tribunals and boards of arbitration. A large part of Ms. Finney's environmental practice involves negotiating with government entities regarding the imposition of regulatory requirements. She also practices commercial litigation and regularly represents clients in mediation and arbitration in that context.
Among Ms. Finney's current and recent engagements are:
- Acting for a multi-national auto parts manufacturer engaged in a series of lawsuits and appeals of administrative orders in relation to allegations of groundwater contamination by industrial solvents
- Defending a leading forestry products company in relation to odour and particulate emissions charges and a related dispute pertaining to indemnity provisions arising out of the sale of the emitting facility
- Acting for petroleum companies in the defence of environmental claims by neighbouring landowners and appeals of administrative orders
- Advised a leading insurance company in relation to whether a brownfields clean-up was carried out negligently by an environmental consultant
- Member of counsel team acting for an energy distribution, supply and service company engaged in a private arbitration pertaining to a force majeure clause contained in a power purchase contract
- Acting for a tenant engaged in private arbitration with its landlord concerning the proper interpretation of a rent renewal clause contained in the lease
Ms. Finney is a member of the Municipal Law and Environmental Law Practice Groups of Davis's Toronto office. As such, Ms. Finney regularly conducts seminars for clients and consultants on recent changes in the environmental law area and is responsible for updating the Davis's Municipal, Planning and Environmental Law blog with respect to developments in the environmental law area.
After graduating from Osgoode Hall Law School in 1993, Ms. Finney served as law clerk to the Honourable E.D. Bayda, Chief Justice of Saskatchewan, following which she was called to the bars of Saskatchewan (1994) and Ontario (1995).
