Biography

Jason Herbert is a litigation partner in the Vancouver office of Davis LLP, where he has practised commercial dispute resolution and regulatory and administrative law since completing his articles with the firm in 1999.

Mr. Herbert regularly advises and acts for a wide range of clients, including professional regulatory colleges and associations, educational institutions, First Nations, corporations, incorporated societies, and individuals. His practice includes professional governance and regulation, health, education, executive employment, freedom of information and privacy, human rights, and aboriginal law.

Mr. Herbert has a particular focus on administrative (public) law, and he has extensive experience advising and assisting public sector clients on a wide range of matters, including bylaw and policy development and drafting, statutory and regulatory compliance, and risk management.

Mr. Herbert has appeared as litigation counsel in proceedings before the British Columbia Supreme Court, the British Columbia Court of Appeal, and the Federal Court of Canada, and before various administrative tribunals, including the Health Professions Review Board, the Office of the Information and Privacy Commissioner of British Columbia, the British Columbia Human Rights Tribunal, the British Columbia Utilities Commission and the Yukon Utilities Board. He has also participated in and designed alternate dispute resolution processes, including arbitration and mediation.

Mr. Herbert was the Silver Medallist in the 1997 graduating class at the University of Toronto Law School, and was called to the British Columbia Bar in 1999 after completing a one-year clerkship with the Supreme Court of British Columbia, with Madam Justice Saunders as his principal. He was also the Governor General's Medallist for the University of British Columbia Faculty of Arts in 1992, and completed a Masters degree in mathematics at the University of Toronto in 1994. Since 2009, Mr. Herbert has also been a member of the Yukon Bar.

Mr. Herbert has been Chair of the Student Recruitment Committee for Davis's Vancouver office since 2008. He is also a member of the firm's National Professional Recruitment Committee, National Technology Committee, and Library Infrastructure Committee.
