Cliff v. Dahl 2012 BCSC 276 (jury strike application), and 2012 BCSC 364, leave to appeal refused, BCCA May 2, 2102 (application to compel disclosure of statements)

The Plaintiff in this action sustained serious physical injuries and a traumatic brain injury as a result of the accident. Ms. Dorey took the lead on two contested defence applications involving an application to strike the jury (which was disallowed) and an application for production of her client's statement of his account of the accident circumstances obtained by the Plaintiff's investigator long before her client was added as a Defendant and Third Party. This application was successful and resulted in an important procedural ruling on the scope litigation privilege.

This case is set for trial in the Fall, 2012.
